1. ACCEPTANCE OF TERMS:

By registering on this platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree to these terms, you must not register or use this platform. These terms constitute a legally binding agreement between you and the platform operator.

2. PLATFORM ROLE AND DISCLAIMER:

This platform acts solely as an intermediary technology service provider connecting doctors with patients. The platform does not provide medical services, medical advice, diagnosis, or treatment. The platform is not a healthcare provider and does not practice medicine. All medical services are provided directly by registered doctors, who are independent practitioners. The platform disclaims all liability for any medical services, advice, diagnosis, or treatment provided by doctors using this platform.

3. REGISTRATION AND ACCOUNT SECURITY:

You agree to provide accurate, current, and complete information during registration. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify the platform of any unauthorized use of your account. The platform reserves the right to suspend or terminate accounts that provide false information or violate these terms.

4. PROFESSIONAL LICENSES AND COMPLIANCE:

You represent and warrant that you hold all necessary medical licenses, certifications, and registrations required to practice medicine in your jurisdiction. You agree to comply with all applicable medical regulations, professional standards, ethical guidelines, and laws governing medical practice. You are solely responsible for maintaining the validity of your professional licenses and certifications. The platform is not responsible for verifying or maintaining your professional credentials.

5. LIMITATION OF LIABILITY AND INDEMNIFICATION:

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PLATFORM, ITS OPERATORS, AFFILIATES, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM, INCLUDING BUT NOT LIMITED TO MEDICAL MALPRACTICE, NEGLIGENCE, OR ANY HARM RESULTING FROM MEDICAL SERVICES PROVIDED BY YOU OR OTHER DOCTORS. You agree to indemnify, defend, and hold harmless the platform from any claims, damages, losses, liabilities, costs, or expenses (including legal fees) arising from your use of the platform, violation of these terms, or any medical services you provide.

6. PAYMENT TERMS AND COMMISSIONS:

The platform charges a commission fee of 6% on all online consultations processed through the platform. This commission is non-negotiable and applies to all transactions. You are responsible for providing a valid UPI ID for receiving payments. The UPI ID cannot be changed after registration without platform approval. The platform is not responsible for payment delays, failures, or disputes arising from incorrect UPI information provided by you. All payment processing is subject to third-party payment gateway terms and conditions.

7. PATIENT DATA AND PRIVACY:

You agree to maintain strict patient confidentiality and comply with all applicable data protection laws, including but not limited to applicable privacy regulations. You are solely responsible for securing, storing, and protecting patient data in accordance with legal requirements. The platform is not responsible for any data breaches, unauthorized access, or misuse of patient information. You agree not to share, sell, or misuse patient data obtained through the platform.

8. PROHIBITED ACTIVITIES:

You agree not to: (a) engage in fraudulent, illegal, or unethical activities; (b) misrepresent your qualifications, credentials, or services; (c) provide false medical information; (d) violate any applicable laws or regulations; (e) interfere with platform operations or security; (f) use the platform for any unauthorized commercial purposes; (g) attempt to circumvent platform fees or payment systems; (h) engage in any activity that could harm the platform’s reputation or operations.

9. APPROVAL AND TERMINATION:

Your registration is subject to platform approval at its sole discretion. The platform reserves the right to approve, reject, suspend, or terminate your account at any time, with or without cause or notice. Upon termination, you must immediately cease using the platform and all associated services. The platform is not obligated to provide reasons for account termination or rejection.

10. INTELLECTUAL PROPERTY:

All platform content, including but not limited to logos, designs, text, graphics, software, and functionality, is the exclusive property of the platform operator and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on platform content without express written permission.

11. SERVICE AVAILABILITY AND MODIFICATIONS:

The platform is provided “as is” and “as available” without warranties of any kind. The platform does not guarantee uninterrupted, error-free, or secure service. The platform reserves the right to modify, suspend, or discontinue any aspect of the service at any time without notice. The platform may modify these terms at any time, and continued use of the platform after modifications constitutes acceptance of the modified terms.

12. DISPUTE RESOLUTION AND GOVERNING LAW:

Any disputes arising from these terms or your use of the platform shall be resolved through binding arbitration in accordance with applicable arbitration laws, or through courts of competent jurisdiction as determined by the platform. These terms shall be governed by the laws of India, without regard to conflict of law principles. You waive any right to participate in class action lawsuits against the platform.

13. FORCE MAJEURE:

The platform shall not be liable for any failure or delay in performance due to circumstances beyond its reasonable control, including but not limited to natural disasters, war, terrorism, pandemics, government actions, internet failures, or third-party service disruptions.

14. SEVERABILITY AND WAIVER:

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The platform’s failure to enforce any provision of these terms shall not constitute a waiver of that provision or any other provision.

15. ENTIRE AGREEMENT:

These terms constitute the entire agreement between you and the platform regarding your use of the service and supersede all prior agreements and understandings. No oral or written statements outside these terms shall modify or supplement this agreement unless expressly agreed to in writing by the platform.
